  • What is the definition of works according to copyright law?

    According to copyright law in China, works can include literature, art, natural science, social science and engineering technology that are expressed in the following forms:

    • Written works;
    • Oral works;
    • Musical, dramatic, choreographic works;
    • Works of fine art and architecture;
    • Photographic works;
    • Cinematographic works and works created by virtue of an analogous method of film production;
    • Drawings of engineering designs, and product designs; maps, sketches and other graphic works and model works;
    • Computer software; and
    • Other works as provided for in laws and administrative regulations.
  • What is the term of protection for copyrights?

    The copyrighted work of a citizen is protected through the lifetime of the author and 50 years after his death (expiring on December 31 of the fiftieth year after the death of the author). The copyrighted work of a legal entity or other organization is protected for 50 years (expiring on December 31 of the 50th year after the first publication of such work – provided that any such work that has not been published within 50 years after the completion of its creation shall no longer be protected under this Law).
